Construction Law

With similar aspects to a previous module, Professional Practice II, along with additional syllabus on a more direct and wide approach towards law under construction, the Construction Law module introduces to students to different disputes or situations that could possibly happen in the construction industry whereby as Quantity Surveyors, we are to prepare & equip ourselves with necessary knowledge throughout the wide range of dispute resolution techniques. The difference between the Professional Practice module is that these techniques are taught throughout different forms of contract or statutes, in PAM Form of Contract 2006, FIDIC Form, CIPAA and Tort Law.

 

With the different forms of contract and statutes in mind, the module teaches students on Formation of Contract, Payment, Contractual Claims, Dispute resolutions, Remedies for Breach of Contract, FIDIC & CIPAA. Similarly to Professional Practice, the module is assessed through a seminar relating to a taught topic, a group assignment report, and a final exam.

The module is taught by Mr. Chong Wei Wong, who as a seasoned professional working part-time at Taylors, I feel has displayed a very knowledgable persona to us students throughout the semester. Studying on Professional Practice II, of which I have repeatedly highlighted its similarity, has allowed familiarity on students as we study, understand and conduct our assignments. Hence, the module has gone through smoothly and fairly well, also with thanks to an experienced lecturer assisting us throughout the semester.

Group Assignment

The Group assignment requires students in groups of 5 to propose a FIDIC Form of Contract along with providing professional advice regarding possible contract issues such as payment, work programme or dispute resolution methods. The group is propose the FIDIC Form role-playing as professionals to a Taylor's University Vice-Chancellor proposing for a development of a Student Accommodation and Outreach Centre project. The report allows for a more critical analysis of the FIDIC Forms through comparisons with the PAM Form of Contract 2006.

I feel that the assignment gave a very analytical approach to studying on the FIDIC Forms as well as the different issues that are studied and subsequently documented in the report. The assignment allows full use of the knowledge gained throughout both Professional Practice and Construction Law module & is hence suited as an assignment in the final semester before we prepare ourselves as professionals. With a very detailed brief of the assignment, along with committed people within the group, my group & I are able to finish the assignment smoothly.
